Vannamei Shrimp Investigations: U.S. Targets Ecuador, India, Indonesia, and Vietnam

The U.S. Department of Commerce initiated antidumping duty (AD) investigations of vannamei shrimp from Ecuador and Indonesia, as well as countervailing duty (CVD) investigations of vannamei shrimp from Ecuador, India, Indonesia, and Vietnam. These investigations, which began on November 14, 2023, followed petitions filed by the American Shrimp Processors Association on October 25, 2023.

The alleged dumping margins for Ecuador range from 9.55% to 25.82%, and for Indonesia, they range from 26.13% to 33.95%. The petitions also claim that these countries, along with India and Vietnam, provide subsidies for shrimp exports at rates above the de minimis threshold (which is less than 1% for developed countries and less than 2% for developing countries).

The products covered by this investigation are certain vannamei shrimp and prawns, including those packed with marinade, spices, or sauce, and food preparations containing more than 20% by weight of shrimp or prawn. However, excluded from the scope are breaded shrimp and prawns, cold water shrimp, fresh shrimp and prawns, shrimp and prawns in prepared meals, dried shrimp and prawns, canned warmwater shrimp and prawns, and certain battered shrimp.

The preliminary determinations for the CVD investigations are expected by January 18, 2024, and for the AD investigations by April 2, 2024. The final determinations for the AD investigations are anticipated by June 17, 2024, and for the CVD investigations by April 2, 2024. If both the Department of Commerce and the International Trade Commission (ITC) find affirmative injury, the orders for AD and CVD could be issued as early as May and August 2024, respectively.

The ITC’s role is to determine whether the imports of vannamei shrimp from these countries materially injure, or threaten to materially injure, the U.S. shrimp industry.
